An above-ground pool can need a permit just like an in-ground one. Many places decide by water depth. Florida law, for example, defines a swimming pool as one holding water over 24 inches deep; many other places use a similar line, so check yours. Once your pool counts, the usual pool rules apply: a barrier around it, a ladder that cannot be used to climb in, and safe power for the pump. Bestway and Intex both say in their manuals that the setup may need permits and that you should check with your local code office.

We did not test these pools. We read each maker's owner's manual, and the pump and ladder manuals where the maker publishes them. We looked up each pump in Intertek's ETL directory to see whether it is listed to UL 1081, the safety standard for pool pumps and filters. We also checked that each Amazon listing is sold by Amazon or the maker.

Does an above-ground pool need a permit?

Often, yes, once it holds enough water. The depth line, the fees and the inspections vary by place. Bestway's manual says the installation must follow local codes and may need building, plumbing, electrical or zoning permits. Intex tells owners they may need to meet local or state rules on safety barriers and fencing, and to contact their local building code office. A permit office will often ask for a simple site plan showing where the pool sits on the lot.

Can the pool wall be the barrier?

The barrier guideline the makers reprint says the top of a pool barrier should be at least 48 inches above the ground, and that for an above-ground pool the barrier can be the pool structure itself. Funsicle's 2026 user guide reprints code-style text that sets the conditions: the wall sits on the ground, its top is at least 48 inches above the ground all the way around, the ladder can be secured, locked or removed, and the pool maker allows the wall to serve as a barrier.

That last condition is the catch. None of the manuals we read says outright that its wall may serve as the barrier. Ask the maker, or ask your local office whether it will accept the wall. If it will not, you need a fence with a self-closing, self-latching gate. We compared pool gate hardware and alarms and fence kits, including a removable pool fence.

The ladder and anything near the wall

Every maker says to remove or secure the ladder when nobody is in the pool. Intex and Bestway reprint the guideline that a ladder on a wall barrier should be capable of being secured, locked or removed, and that the opening left behind should not let a 4 inch ball through. The makers also say to keep chairs, tables and toys at least 4 feet from the pool, and to place the pump and filter where children cannot climb them to reach the water.

Outlets, GFCI and the pump

The manuals for every pool here say to place the pool at least 6 feet from any electrical outlet, and to protect 125-volt, 15 and 20 amp outlets within 20 feet of the pool with a GFCI. Bestway's manuals also print a 5 foot figure; we use the longer 6 feet. Intex says to plug the pump only into a grounded outlet with GFCI protection, with no extension cord, timer or plug adapter, and Bestway also says not to use extension cords. The electrical code in your area governs, so if you need a new outlet, ask whether it needs an electrical permit.

For the pump, look for the ETL or UL mark and the model number on its label. You can look the model up in Intertek's ETL directory, where we found Funsicle and Bestway pumps listed to UL 1081. Intex says its pumps conform with UL/CSA standards, but we did not find an Intex entry in that directory.

Ground and footprint

All the makers say to set up on flat, level, compacted ground, not on sand, mud, loose soil, a deck, a balcony or a platform. Bestway adds no overhead power lines and nothing buried under the pool, such as utility lines. Intex's Clearview manual asks for a pad under each support leg on ground other than concrete. Find out where buried lines run before you level the ground, and measure the full footprint, including the space around the pool, against your lot's setbacks.

What to hand your permit office or inspector

Bring the owner's manual, the pump manual and a photo of the pump label, and the ladder manual if there is one. Add a sketch showing the pool's size, its distance from property lines and the house, and where the nearest outlets are. If you plan to use the pool wall as the barrier, bring anything the maker gives you in writing that says the wall can serve.
