Many backyard fences need no building permit, but that is only half the answer. Zoning still limits how tall a fence can be, especially in the front yard and at street corners. Your HOA may have its own rules, and the fence has to sit on your side of the property line. A fence around a pool is a pool barrier, and that is checked at inspection.

Do you need a permit for a fence?

Often not a building permit, but check. The model International Residential Code (IRC R105.2) lists fences up to 7 ft as work exempt from a building permit where it is adopted. It also says the exemption does not allow work that breaks other local laws, and cities change the numbers. Seattle, for example, needs no permit for a fence up to 8 ft (with no masonry or concrete over 6 ft), but its zoning still limits most fences to 6 ft. Denver needs a zoning permit for any fence over 4 ft, and a permit for any fence in a historic district. Look up your own address before you buy.

Height limits, corners and property lines

Most places allow a taller fence behind the house than in front. Phoenix limits fences in the required front yard setback to 40 in. and allows up to 6 ft around side and rear yards. Denver allows 4 ft in front of the house and 6 ft behind it. Seattle limits fences in a front or street-side setback to 4 ft.

Corners have their own rule. Phoenix allows nothing over 3 ft inside the sight triangle at street corners and driveways, so drivers can see. Setbacks are often measured from the property line, not the edge of the pavement, and Denver keeps fences 6 in. back from the public sidewalk and off a neighbor's land.

Before you dig, know exactly where your property line is. A survey settles it. WamBam's own guide asks whether you are sure of the line and reminds you that HOAs may regulate height, style and placement. Get HOA approval first if you have one, and call 811 so buried utility lines are marked before you set posts.

Pool fences: what the barrier has to do

Pool barrier rules are stricter than yard fence rules. The model pool code (ISPSC section 305) asks for:

  • A barrier at least 48 in. high, measured on the side away from the pool.
  • No more than 2 in. of clearance under it over grass or gravel, and 4 in. over a solid surface.
  • No opening a 4 in. ball could pass through.
  • Gates that open outward, away from the pool, and close and latch by themselves. If the latch release sits lower than 54 in., it has to be on the pool side, at least 3 in. below the top of the gate, with no opening over 1/2 in. within 18 in. of it.

A latch alone does not make a gate self-closing, so plan the hinges too. We compared self-latching gate latches and self-closing hinges in our pool safety and gate hardware guide.

Maker claims about "pool code" vary in strength. WamBam says the Sturbridge "conforms to BOCA pool code", but BOCA is an older code family that the ICC codes replaced, so check it against your local rule. The Sturbridge drawing also shows a 2 in. gap under the panel, which leaves no slack over grass, so keep the ground level along the run.

Removable mesh pool fences

The model code allows mesh pool fences with limits: installed per the maker's instructions, no more than 1 in. between the bottom of the mesh and the deck, and attachment devices at least 45 in. above the ground. Some places go further. Phoenix accepts mesh only if it meets ASTM F2286 (the standard for removable mesh pool barriers), is at least 60 in. tall, and has posts no more than 40 in. apart, so the 4 ft Life Saver section here would not do there. Los Angeles allows only permanently installed mesh. Life Saver's FAQ says only that it has not found a code its fence does not meet, and names no standard, so ask your building department before you drill the deck.

Wind, frost and no-dig posts

No-dig kits drive a steel pipe into the ground instead of setting posts in concrete. WamBam says its pipes go 24 to 40 in. deep depending on style and that frost heave is less of a problem than with concrete, but whether a no-dig fence is acceptable where a permit is needed is up to your building department. Wind claims are thin across the board: WamBam's Cambridge page says wind tested to 60 mph with no test report, and Life Saver's warranty excludes wind damage. WamBam also says it does not sell for three South Florida counties because fences there need special permits, which is a reminder that high-wind areas can ask for more.

What to hand your permit office or inspector

Bring the install guide and spec sheet for the exact model, with the real finished height, post spacing and post depth marked. Add a site sketch showing the property line, the street side and any pool. For a pool fence, include the gate, latch and hinge instructions, and test that the gate closes and latches by itself from any open position before the inspection.

Do I need a permit to build a fence?
Often not a building permit for a standard backyard fence, but it depends on the place. The model IRC exempts fences up to 7 ft, Seattle exempts up to 8 ft, and Denver needs a zoning permit for anything over 4 ft. Check the rule for your address.
How tall can a fence be in the front yard?
Usually lower than in back. Phoenix allows 40 in. in the front setback and 6 ft around side and rear yards, Denver 4 ft in front and 6 ft behind, and Seattle 4 ft in a front or street-side setback. Corners can be lower still.
What does a pool fence need?
