Whether a pergola or gazebo kit needs a permit depends on where you live, how big it is, what kind of roof it has and whether it is attached to the house. The model residential code most states start from, the 2021 IRC, exempts a one-story detached accessory structure of up to 200 square feet from a building permit. Many places change that limit or review a roofed patio cover differently, and setbacks still apply when no building permit is needed.

We did not test these kits. We read each maker's product pages, assembly manuals and warranty terms, noted where a maker publishes two different numbers, and checked that each Amazon listing is sold by Amazon or the maker. Open, louvered or solid roof

The kits here come with three kinds of roof. An open slat roof, like the Beaumont, has no covering. A louvered roof, like the Sarasota, has steel blades that close to shed rain. A hardtop, like the Barrington, Norwood, Kozyard and Yardistry, has a solid steel or aluminum roof.

Local codes draw the line in different places. Some offices treat an open pergola as an accessory structure and a solid or louvered top as a patio cover with its own review. Escondido, California, for example, requires a design and plan check for a solid roof patio cover built any other way than its handout shows. Ask your office which category your kit falls into before you buy.

The 200 square foot line, and what it leaves out

Section R105.2 of the 2021 IRC exempts one-story detached accessory structures of up to 200 square feet of floor area from a building permit. It covers detached structures only, so a cover attached to the house is outside it. The same section says the exemption does not allow work that breaks other local laws, so setbacks and height limits still apply, and so can HOA rules. Many places adopt a lower limit.

By the makers' published sizes, every kit here is under 200 square feet, from about 115 square feet for the Sarasota to about 170 for the Yardistry 12 x 14. A place with a smaller limit, or one that counts the full roof area, can still put the same kit over the line. Wiring in lights, a fan or outlets is electrical work, which the 200 square foot exemption does not cover.

Wind and snow figures depend on anchoring

Your building department sets the design wind speed and ground snow load for your area in the IRC's climate table, R301.2(1). One Maryland county, for example, lists 120 mph and a 20 pound per square foot ground snow load. You can look up your address in ASCE's free Hazard Tool, then ask the building department which edition and risk category it uses.

  • Backyard Discovery's 100 mph figure applies only when the kit is anchored as its manual specifies.
  • Kozyard says 60 mph "when properly anchored" on its product page, but its manual says to open or remove sidewalls and netting in winds over 30 mph. Plan with the lower number.
  • The Sarasota manual says to turn the louvers fully open when high wind, ice or snow is expected.
  • Makers state snow as roof weight or depth, such as 7,500 pounds or 30 inches for the Barrington and 2,500 pounds for the Kozyard. That is not the same as your area's ground snow load, so ask your office how it wants roof snow load shown.
  • Yardistry publishes no wind or snow number and says accumulated snow must be removed from the roof.

Anchoring and warranty terms

Backyard Discovery includes concrete anchors but says hardware for a wood deck is not included and the deck needs ample structural support under it. It recommends a concrete surface or concrete post pads. Kozyard strongly recommends anchoring into concrete, with 3/8 x 3 inch sleeve anchors (not included) in concrete over 3 inches deep, and only after assembly is finished. Yardistry supplies post mounts but no anchoring hardware, and tells you to check local building codes for acceptable installation. Where the ground freezes, local frost depth can call for deeper footings than a kit drawing shows.

Warranties do not cover storms. Backyard Discovery's warranty is void if the kit is not installed per its assembly instructions, and it excludes wind and storms as acts of nature. Kozyard's warranty excludes damage from wind and snowstorms, and Yardistry's excludes acts of nature including wind. A wind figure is not a promise to pay for storm damage.

What to hand your installer or building department

Send the maker's assembly manual, the product page showing outside dimensions and any wind and snow figures, and the anchoring layout or footing drawing. Add a simple site plan with distances to property lines and the house. Since none of these makers publishes stamped plans, an office in a high wind or heavy snow area may ask for an engineer's letter, so ask before you order.

Does a pergola need a permit?
It depends on where you live. The 2021 IRC exempts detached one-story accessory structures up to 200 square feet, but many places set a lower limit or treat a solid or louvered roof as a patio cover. Check the rule for your address.
Does a hardtop gazebo need a permit?
Often, if it is permanent or over the local size limit. The makers say so themselves: Backyard Discovery and Yardistry both warn that permanent structures may require a building permit and tell you to check with your local planning, zoning and building departments.
What wind rating does my pergola or gazebo need?
Whatever your building department uses for your area, which comes from its climate table or the ASCE wind maps. A maker's figure, such as Backyard Discovery's 100 mph, only applies when the kit is anchored as its manual specifies.
Can I put a gazebo or pergola on a wood deck?
Some makers show how, but check the deck first. Backyard Discovery says deck hardware is not included and the deck needs ample structural support under it, and Yardistry shows a deck example with anchoring hardware sold separately. Ask your inspector what your deck needs.
